Legal
Terms & Conditions
Last Updated: 14 April 2025
These Terms and Conditions govern the use of this website and, where applicable, the provision of legal services by Sukhothai ("we", "us", or "our") to clients ("you"). Please read them carefully. By using this website or engaging our services, you accept these terms. If you do not accept them, please do not use the site or proceed with an engagement.
Separate client engagement letters govern the specific terms of each matter. Where there is a conflict between these Terms and Conditions and a signed engagement letter, the engagement letter prevails.

1. About Sukhothai
Sukhothai is a criminal defense law practice operating in Bangkok, Thailand. Our principal office is located at 73 Phloen Chit Road, Lumphini, Pathum Wan, Bangkok 10330. All practitioners are registered with the Lawyers Council of Thailand and are subject to its professional rules and disciplinary framework.
We provide services in three defined areas: pre-charge investigation and police interview counsel; bail application and pre-trial representation; and statute and charge sheet review. Services outside these areas are not offered through this engagement framework.
2. Use of This Website
This website is made available for informational purposes. You may use it to learn about our services, read general legal information relevant to criminal proceedings in Thailand, and contact us with an enquiry.
You agree not to use this website to:
- Submit information that is false, misleading, or submitted on behalf of another person without their knowledge
- Attempt to gain unauthorised access to any part of the site or its underlying systems
- Introduce malicious software or interfere with the website's operation
- Use any automated means to scrape or collect content from the site without permission
We reserve the right to restrict access to the website at any time and without notice if we reasonably believe these terms are being violated.
3. Not Legal Advice
The content published on this website — including service descriptions, FAQ responses, and informational text — is provided for general information only. It does not constitute legal advice and does not create a solicitor-client relationship.
Legal outcomes depend on the specific facts of each matter, applicable Thai law, and the conduct of the relevant proceedings. Nothing on this website should be taken as an indication of likely outcome in any particular situation.
A formal legal relationship is established only upon execution of a signed engagement letter and payment of any required initial fee. Until that point, any communication with us — including through the contact form — does not create professional obligations on either side, though we treat all communications with the same care for confidentiality.
4. Engagement of Legal Services
Where you wish to retain Sukhothai for a legal matter, the following process applies:
- Initial contact is made through the website form, by telephone, or by email
- We will conduct a conflict of interest check before confirming our availability to act
- Where we are able to act, a written engagement letter is issued setting out scope, fee, and terms specific to the matter
- The engagement commences upon your written acceptance of the engagement letter and receipt of any agreed initial payment
We may decline to accept an engagement at our discretion, including where a conflict of interest exists, where the matter falls outside our areas of practice, or where we are unable to adequately serve the client's needs given current capacity.
Each of our three service areas has a fixed fee as published on our website. These fees cover the defined scope of work described. Work outside the stated scope is not included and would require a separate engagement.
5. Fees and Payment
Our current service fees are:
| Service | Fee (THB) |
|---|---|
| Pre-Charge Investigation & Police Interview Counsel | ฿33,500 |
| Bail Application & Pre-Trial Representation | ฿18,500 |
| Statute & Charge Sheet Review | ฿4,500 |
All fees are denominated in Thai Baht and are inclusive of applicable value-added tax unless otherwise stated in the engagement letter. Fees are payable in advance unless an alternative arrangement is specified in writing.
Payment methods accepted are set out in the engagement letter. Where a matter does not proceed following payment, a partial or full refund may be offered at our discretion, depending on the work already carried out. This is addressed in the relevant engagement letter.
Fees published on our website reflect current pricing and may be updated without notice. The fee applicable to your matter is the one confirmed in your engagement letter, which supersedes any website pricing at the time of engagement.
6. Confidentiality and Legal Professional Privilege
All communications between you and Sukhothai in the context of a legal matter are treated as confidential. This includes information provided through the website contact form, by email, by telephone, and in person.
Where a formal engagement exists, communications are additionally protected by legal professional privilege under Thai law, meaning they cannot ordinarily be compelled in evidence or disclosed to third parties without your consent.
We maintain confidentiality obligations that continue beyond the conclusion of any engagement. We do not discuss client matters with third parties except where required to do so by law, where you have expressly consented, or where necessary to carry out the work you have instructed us to do (for example, in coordinating with sureties in a bail matter).
7. Limitation of Liability
We carry professional indemnity insurance in accordance with our obligations as registered legal practitioners in Thailand. Our liability to you in connection with any legal matter is subject to the terms of the relevant engagement letter and applicable Thai law.
To the extent permitted by law, our total liability in respect of any claim arising from the provision of legal services is limited to the fee paid for the specific service giving rise to the claim.
We are not liable for:
- Decisions made by courts, prosecutors, or police in the exercise of their discretion
- Outcomes in matters where we have provided advice but the client has chosen to proceed differently
- Loss or damage arising from your reliance on general information published on this website rather than specific legal advice
- Any indirect, consequential, or incidental loss arising from the use of this website
Nothing in these Terms and Conditions limits liability for fraud, wilful misconduct, or any liability that cannot be excluded under Thai law.
8. Intellectual Property
All content published on this website — including text, layout, design elements, service descriptions, and case summaries — is the property of Sukhothai and is protected by applicable intellectual property law.
You may read and print content from this website for your own personal, non-commercial use. You may not reproduce, republish, distribute, or adapt any content from this website for commercial purposes without our written permission.
Documents prepared for you as part of a legal engagement — such as written charge reviews, bail applications, or statements — remain subject to legal professional privilege and are for your use in the relevant matter only. They are not to be distributed or published without our consent and yours, given the sensitivities typically involved.
9. Termination of Engagement
Either party may terminate a legal engagement by written notice. The following conditions apply:
- Termination by you: You may instruct us to cease acting at any time. Fees already paid and attributable to work completed to that point are non-refundable. Where work has not yet commenced, a full or partial refund will be considered.
- Termination by us: We may cease acting where a conflict of interest arises, where you have provided materially false information, where instructions become ethically problematic, or where fees remain unpaid. In such cases we will give reasonable notice and take steps to minimise prejudice to your position.
Upon termination, we will return documents provided by you and retain copies only as required by our professional obligations or applicable data retention requirements.
10. Complaints and Dispute Resolution
If you have a concern about our services, we ask that you contact us in the first instance by email at [email protected] or by telephone on +66 2 845 7392. We will acknowledge your concern within three working days and aim to respond fully within fourteen days.
If your concern is not resolved to your satisfaction, you have the right to refer the matter to the Lawyers Council of Thailand, which has jurisdiction over professional conduct complaints.
We value the opportunity to address concerns directly and will approach any complaint with care and without prejudice to your ongoing matter where one is in progress.
11. Governing Law
These Terms and Conditions, and any engagement arising from them, are governed by and construed in accordance with the laws of the Kingdom of Thailand. Any dispute arising from or in connection with these Terms or any engagement shall be subject to the exclusive jurisdiction of the courts of Thailand.
12. Changes to These Terms
We may update these Terms and Conditions from time to time. The date at the top of this page indicates the most recent revision. We will make reasonable efforts to draw material changes to the attention of active clients. Continued use of the website following any update constitutes acceptance of the revised Terms.
